The Palmyra Zoning of Appeals held their meeting on November 17, 2016 at the Palmyra Fire Station. In attendance were Chairman Carolyn Pfieffer-Fiala, Vice-Chairman Mitch McLay, Jamie Brawley, Jeffery Swenton, and Zoning Inspector Sandy Nutter, and Secretary Kim Spencer.

The meeting was called to order at 7:10 p.m.

Minutes from July 28, 2016 were read by Kim Spencer.

Chairman’s report:

John Mack withdrawled his appeal for the Bed and Breakfast. His application fee has been refunded to him.

Virgil & Carolyn Reagan of 4937 John Thomas Rd, Ravenna Ohio 44266, wants to buy the house on 8372 Tallmadge Rd. Ravenna, Ohio 444266 and build a garage 50X70 behind the house.

Discussion by members for variance ensued.

Carolyn Pfieffer-Fiala made a motion to issue a conditional use variance for home business that engages trucks:

Article 3 Section 303 Permitted Use

Article 4 Section 410 Residential District

Section 410-1 Uses Permitted

Mitch McLay seconded the motion, and all were in favor. The motion passed.

A motion to adjourn meeting by Carolyn Pfieffer-Fiala at 7:41pm. Motion seconded by Mitch McLay, and unanimously approved.

A Special Meeting was called to Order by Carolyn Pfieffer-Fiala to approve the minutes from the November meeting.

The November minutes were read by Kim Spencer, A motion by Jamie Brawley to accept the minutes as read was seconded by Carolyn Pfieffer-Fiala, and all approved.

The Palmyra Zoning of Appeals held their meeting on July 28, 2016 at the Palmyra Fire Station. In attendance were Chairman Carolyn Pfieffer-Fiala, Vice-Chairman Mitch McLay, Jamie Brawley, Jeffery Swenton, Zoning Inspector Sandy Nutter, and Secretary Kim Spencer.

The meeting was called to order at 7:03 p.m.

Carolyn made a motion to approve the June 23, 2016 minutes, Mitch 2nd them and it was unanimous approved.

Zoning Report:

Duke Regan of 17553 Normandy Rd, Lake Milton, Ohio 44429, would like to put up a sign at his bar/restaurant at 10158 Tallmadge Rd, Diamond, Ohio 44412.

Chairman’s report:

Duke Regan presented to the Board of Appeals his proposal for the installation of a new sign at his bar The Ace of Diamonds. The board discussed it with him and several people from the community.

Carolyn made a motion to approve up to 50 ft. various for the sign. Not less than 25 feet from the road. Mitch 2nd it, Carolyn said yes, Mitch said yes, Jeffery said yes, Jamie said no. The motion did pass.

Carolyn made a motion to approve a various of 20 ft. (wide in size) and height 12 ft. for the atm sign and a total of 18 ft. height. Mitch 2nd it, Carolyn said yes, Mitch said yes, Jeffery said yes, Jamie said no. The motion did pass.

It was stated by Duke Regan that if the light was too bright for the neighbors to let him know and he would change the bulbs. And also the sign will be off when the bar is closed, and most holidays.

A motion to adjourn meeting by Carolyn at 7:55pm. Motion seconded by Jamie, and unanimously approved.

Carolyn made a motion to accept the minutes from April 2016 with one correction, Jamie 2nd it and it was unanimously approved.

Zoning Inspectors Report:

James Brissey at 9459 Tallmadge Rd, Diamond Ohio 44412 is in violation of the Zoning Resolution specifically, Article IX Section 901. There is a new building that does not have a Zoning Permit.

Chairman’s Report:

James was sworn in by Carolyn.

Carolyn made a motion to approve Article 5-Section 502-C, property for non –conforming use, Mitch 2nd it and it was unanimously approved.

Carolyn made a motion from Article 3- Allow building to remain. Mitch 2nd it and it was unanimously approved.

Carolyn made a motion for various set back and sideline, Motion to approve with 30 feet various for back and 6 ft for side property, Mitch 2nd it and it was unanimously approved.

Zoning Inspectors Report: (2nd issue)

David & Melody Traugh, PO Box 95, Mogadore, Ohio 44260, Location-3253 ST. RT. 225, Diamond, Ohio 44412. Is in violation of the Zoning Resolution, specifically Article III, Section 303, does not meet definition of family, operating a business in a residential area.

Chairman’s Report:

David Traugh, Owner-Country Homes and Remodeling LLC, Mark Parker, Supporter, Ernie Kemppo, Pastor, Supporter, Samual Wittman, Lives at GRIP. Debbie Bradford, Neighbor, Sandy Jenkins, Neighbor were all sworn in by Carolyn.

There was a discussion among the Board members and the guests listed above.

Carolyn made a motion on the table to modify the definition of family to a non-conforming family, Carolyn-No, Mitch-No, Jamie-No. This motion did not pass.

Carolyn made a motion to allow the accessory building for business use per condition permit, Carolyn-No, Mitch-No, Jamie-No. This motion did not pass.

A motion to adjourn meeting by Carolyn Pfieffer-Fiala at 8:35 pm. Motion seconded by Mitch McLay, and unanimously approved.

The Palmyra Zoning of Appeals held their meeting on April 21, 2016 at the Palmyra Fire Station. In attendance were Chairman Carolyn Pfieffer-Fiala, Vice-Chairman Mitch McLay, Jamie Brawley, Zoning Inspector Sandy Nutter and Secretary Kim Spencer. Our guests were Mr. & Mrs. Ted Miller, Les Miller. Lynn Mollohan was excused.

The meeting was called to order at 7:10 p.m.

A motion by Carolyn to not re-read the minutes that were approved at the March 2016 meeting, it was seconded by Jamie, and unanimously approved.

Chairman’s report:

Carolyn made a motion to have this meeting a special meeting, because it was not on the fourth Thursday of the month. It was seconded by Mitch and unanimously approved.

The Millers are asking for a various, Section 303, to stay in their existing house until the new house is built, and then at that time the house and garage will be demolished. .

Les Miller of 89 Homes (the builder) was sworn in, he explained to the Board that the same well and septic system would be staying in its existing areas.

Carolyn made a motion for a various to permit one year to build and have old house and garage demolished when the new house is finished. It was seconded by Mitch and unanimously approved.

Carolyn made a motion to extend Jim Sanders conditional permit 18 months to complete building of home. It was seconded by Mitch and unanimously approved.

A motion by Jamie was made to adjourn the meeting at 7:25 pm. It was seconded by Mitch and unanimously approved.

Carolyn Pfieffer-Fiala called the meeting to order on April 21, 2016 at 7:33 pm.

Jamie Brawley made a motion to accept the minutes as read and submitted, it was seconded by Mitch MaLay and unanimously approved.
